I am thinking of taking the situation with my DS, to a higher level!! I am not sure though, who I would go to, like congress, or senator? But, I don't think that I will get anywhere, but, at least I will have the satisfaction of trying, then to be wondering what if I would have done something!!!
I also am very uneasy, that if she gets away with absolutley nothing, then she just might hit one of the other kids, in the "park". And it could possibly be more than a broken elbow!!

Seems we are all in agreement that Mom 2-4 definetly needs to take this to some higher officials, Not only to show this woman that she is in the wrong, but to keep the rest of the children in that area safe from her bad driving habits.

Yes, I did have a free consultation with a lawyer. They were unsure if they wanted to represent me. They said if the insurance would suggest that it was her fault, then they would represent me. If it is determined to be my sons, than that particular law office would not represent us. But, that was before, I found out that she did not have a drivers liscence. They did state that just because they would not take the case, it does not mean that I do not have a case, that they would refer me to someone that would represent it.
I did walk up to her home today, to peek at her car, and I could not see a dent in the side of her car!!! I must call the insurance, and find out if and when they are coming out if I can also see the dent. I really don't want to confront her by myself at this time.

I am curious to know if you find there is front-end damage to her vehicle.
Perhaps someone in authority took photos of the damage to her car the DAY of the accident? Thought this was usually one of the first things that would be done to preserve any evidence. You know, before the owner can "clean" it or "fix" it.
I have heard that it is wise to always keep a disposable camera in one's glovebox in case of an accident so the "innocent" party who is hit can preserve the location of the vehicles in the road (getting the license plate, too), the surrounding scene and any damage done to the vehicles. This certainly doesn't apply in your case. But I would think SOMEBODY thought to preserve the evidence.

This is where another problem comes in here! Stupidly on my part we did not call the police until the following day. I thought the hospital was going to contact the police, but they did not! Even if they had been contacted immediately, it would not have mattered. As she did not stop!! She went home and parked her car. And of course my son walked home, he did not know any better, and neither did any of the kids that were there!!
I really did not think that ds's injury was going to be to the extent that it is!! Or I would have contacted the police immediately. Boy, what a hard way to learn a lesson!!! Typical me, always have to learn the hard way.
